The Embassy of Cap Verde in Germany refused to comment on the legal situation for homosexuals on the island. According to ILGA the Portuguese Penal Code of 1866, which stayed in force after independence, de facto criminalizes homosexual behaviour. Sections 390 and 391 prohibit "acts against nature", and "assaults on public or personal decency". Sections 405 and 406 prohibit "prostitution", and "the corruption of minors". Repeat offenders can be imprisoned. This former Portuguese Island on Africa's western tip was a convenient base for ships transporting slaves to Europe and the Americas. In 1975, Cape Verde finally gained independence from Portugal.
